Preamble

The company Paris Vices, a simplified joint-stock company (SAS) currently being incorporated, whose registered office is located at 89 rue Cardinet, 75017 Paris, France (hereinafter referred to as “Paris Vices” or “the Publisher”), operates the website accessible at www.parisvices.com (hereinafter referred to as “the Site”).

The Site is hosted by IONOS SARL, 7 Place de la Gare – BP 70109 – 57201 Sarreguemines Cedex – France.

These Terms and Conditions of Use (hereinafter the “TCU”) set out the terms and conditions for access to and use of the Site and its related services (hereinafter the “Services”).
They are complemented by the Paris Vices Charter, available at any time at www.parisvices.com/charte.

By accessing the Site or using its Services, the user acknowledges having read, understood, and unreservedly accepted these TCU and the Charter.

Article 1 – Definitions

For the purposes of these TCU, the following terms shall have the meanings set out below:

  • Cookies: files placed on the user’s device enabling the storage of browsing information.
  • Personal Data: any information relating to an identified or identifiable natural person, within the meaning of the General Data Protection Regulation (GDPR).
  • Services: all functionalities accessible on the Site, whether free or paid.
  • User: any natural person aged 18 or over accessing the Site and using the Services.
  • Event: a meeting or activity proposed by a user or partner via the Site.
  • Official Page: a profile representing a venue, establishment, or third-party entity (e.g. a bar, club, etc.).
  • Site: all web pages accessible at www.parisvices.com.
Article 2 – Purpose of the Site

Paris Vices is a community platform designed to foster encounters between consenting adults sharing an open-minded view of sensuality and libertinism.
The Site is strictly reserved for adults. Registration by minors is strictly prohibited.

Use of the Site for professional, commercial, advertising or similar purposes (escort services, prostitution, paid services, etc.) is forbidden.

Registration is free of charge, although some features are accessible only through a paid subscription.

The Site is provided “as is” and according to its availability. Paris Vices endeavours to maintain continuous service 24/7 but reserves the right to temporarily suspend access for maintenance, updates, or in cases of force majeure.

Paris Vices may modify the content, functionalities, or access conditions of the Site at any time. Users will be notified by any appropriate means.

Article 3 – Services Provided
Free Services
  • Creation of an account and personal profile;
  • Browsing other users’ profiles and listings;
  • Access to Official Pages and public Events.
Paid Services
  • Sending and receiving private messages;
  • Registration, creation or management of Events;
  • Access to advanced features (highlighted listings, fans, unlimited interactions, etc.).

Current rates are available on the Site. Payments are processed through a secure interface operated by [payment provider].

Banking data is transmitted directly to [payment provider], acting as a payment intermediary. This data is neither accessible to nor retained by Paris Vices.

Subscriptions may be purchased with or without automatic renewal. If renewal is activated, it occurs at the end of each initial period unless cancelled by the user at least fifteen (15) days before the renewal date.

In accordance with Article L.221-28 of the French Consumer Code, the right of withdrawal does not apply to services that have been fully performed before the expiry of the fourteen-day period, with the user’s prior express consent.

Article 4 – Registration and Access
4.1 Conditions of Registration

Access to Services requires prior registration. Only adults may create an account.
Registration constitutes full and unconditional acceptance of these TCU and of the Paris Vices Charter.
The user must provide accurate information: username, e-mail address, password, date of birth, city, and certain preference-related data.
A confirmation email will be sent to validate the registration.
Paris Vices recommends using a pseudonym and discourages the disclosure of personal information (real name, address, etc.).

4.2 Accuracy and Security of Data

Users must keep their account information up to date. In the event of false statements or misuse, Paris Vices reserves the right to suspend or delete the relevant account.
Login credentials and passwords are strictly personal and must not be shared. Any login from an account is presumed to originate from its holder.
In case of loss or fraudulent use, users must contact Paris Vices via the “Contact Us” section.

4.3 Profile Publication

Data (excluding email, phone number, and postal address) as well as photos or videos provided by the user may be published on the Site, accessible only to other members.
The user grants Paris Vices a non-exclusive, royalty-free licence to display such content within the Site.
Content may be modified or deleted at any time via the “Settings” section.

Article 5 – User Obligations

The user agrees to:

  • comply with applicable laws;
  • behave respectfully, courteously, and in accordance with the Paris Vices Charter;
  • not use the Site for commercial or advertising purposes;
  • not post content that is violent, defamatory, obscene, illegal, hateful, or contrary to public order;
  • not reproduce, copy, or extract Site content (profiles, photos, messages, etc.) without authorisation;
  • not attempt to disrupt the proper functioning of the Site.

The user shall indemnify Paris Vices against any third-party claims arising from the content they publish.

Article 6 – Moderation

Content published on the Site may be moderated either prior to or after publication.
Paris Vices reserves the right to remove, without notice, any content deemed inappropriate, contrary to these TCU or to applicable laws.

Anyone may report objectionable content via the “Contact Us” section, providing all necessary details (identity, link, reason, etc.).
Author details will only be disclosed following a lawful judicial request.
Paris Vices may report illegal content to the competent authorities.

Article 7 – Personal Data

Users’ personal data is collected and processed in compliance with Regulation (EU) 2016/679 (GDPR) and the French Data Protection Act (Loi Informatique et Libertés).

Main processing purposes include:

  • management of user accounts;
  • facilitating interactions between members;
  • communication of information and notifications;
  • security and fraud prevention;
  • service improvement and internal statistics.

Data is hosted on secure servers operated by IONOS (France) and is not transferred outside the European Union.

Users have the following rights: access, rectification, erasure, objection, portability, and restriction of processing.

Upon account deletion, data is erased within a maximum of three (3) months, unless retention is required by law.
Users may also lodge a complaint with the CNIL (www.cnil.fr).

Article 8 – Liability

Each user is solely responsible for the information, images, and content they publish on the Site.

Paris Vices does not guarantee the real identity of users or the accuracy of the information they provide.
Meetings organised via the Site are the sole responsibility of the participants.

Paris Vices recommends that first meetings take place in public venues and that a friend or relative be informed.

Paris Vices shall not be held liable for:

  • technical malfunctions beyond its control;
  • service interruptions;
  • improper use of the Site;
  • any damage arising from a user’s voluntary disclosure of personal information.

Users agree to indemnify Paris Vices for any damage caused by their negligence or breach of these TCU.

Article 9 – Confidentiality

Paris Vices places great importance on the privacy of its members.
The detailed principles governing data collection, storage and use are set out in the Privacy Policy, available on the Site.
Use of the Site constitutes acceptance of this policy.

Article 10 – Intellectual Property

All elements of the Site (texts, visuals, logos, trademarks, structure, source code, etc.) are the exclusive property of Paris Vices.

Any reproduction, distribution, modification, or reuse, in whole or in part, without prior written consent is prohibited and may lead to legal action.

Creating a hyperlink to the Site also requires the express authorisation of Paris Vices.

Article 11 – Termination

Users may close their account at any time through the “Settings” section.

Paris Vices may suspend or delete an account in case of breach of the TCU or the Charter.
In such cases, fees already paid will not be refunded.

The user will be notified of account termination by email.
Account-related data will be deleted within three (3) months in accordance with Article 7.

Article 12 – Amendments to the TCU

Paris Vices may amend these TCU at any time to reflect updates to the Site, legislation, or industry practices.

Users will be informed of such amendments by internal message or notice on the Site.
Continued access to the Site after publication constitutes acceptance of the revised terms.

Article 13 – Governing Law and Jurisdiction

These TCU are governed by French law.
In case of dispute regarding their interpretation or performance, the courts of Paris shall have exclusive jurisdiction, unless mandatory legal provisions provide otherwise.
